Texas Electric Railway Employment Agreement effective 1 January 1947; pages 24-25. This pocket-sized, 52 page book, documented employment regulations for various classes of railroad workers. [pages 24-25 transcribed] [cont'd from page 23] such general tools and accessories as in its judgment are necessary to perform their work, except such tools as are customarily furnished by skilled workmen, to be returned in good condition when leaving the service, ordinary wear, tear and depreciation excepted, or payment made therefor. All employes [sic] shall be responsible to the Company for all equipment, tools, materials, and supplies entrusted to their care. ARTICLE 27 Transferring Household Goods (a) Employes [sic] transferred from one location to another by direction of the Company, or in exercising their seniority rights, will be entitled to move their household effects over the lines of the Company without payment of freight charges, exclusive of pick-up and delivery, loading and unloading. (b) The provisions of this Article shall apply only to such free transportation as the Company may legally perform. ARTICLE 28 Physical Examinations Any employe [sic] covered by this agreement may be required, as directed by the Company, to report at any time and at any point on its lines of railway to undergo physical examinations. The medical expense of such examinations shall be borne by the Company. Any time lost, and reasonable necessary expenses incurred, if any, will be paid by the Company. If this examination is used as the basis for discharge or demotion, the employe [sic] af- ---24--- fected shall receive a copy of the medical report, and the employe [sic] or the Union may have an additional examination made within ten (10) days by a doctor selected by the Union. If the report of the Union doctor is at variance with the Company doctor, the Company shall receive a copy of the medical report of the Union doctor. A third examination shall be made by a doctor agreed upon by the Company and the Union doctors and whose examination shall be controlling. The Union or the affected employe [sic] shall bear the expense of the examination by the Union doctor, and the Union and the Company shall bear equally the expense of the examination by the third doctor. The procedure herein provided precludes the application of Article 22. ARTICLE 29 Probationary Period It is understood that new trainmen are on probation for the first ninety (90) days of employment (exclusive of training period, if any), and all other employes [sic] sixty (60) days, and that the Company may, at its on discretion, discipline or discharge any such employe [sic] during such probationary period, and no grievance shall be claimed thereby. ARTICLE 30 Service Letters When requested in writing, employes [sic] leaving the service will be furnished service letters, showing date of entry of service, date of termination of service, and capacity in which employed. ---25--- |
