[page 1 transcribed] BEFORE THE INTERSTATE COMMERCE COMMISSION In the Matter of the Application of Finance Docket TEXAS ELECTRIC RAILWAY COMPANY No………………… for certificate of public convenience, and necessity under section 1, paragraphs (18) to (20), inclusive, of the Interstate Commerce Act, permitting the abandon- ment of its entire line of railroad and the operation thereof. _________ RETURN TO QUESTIONNAIRE _________ TO THE HONORABLE INTERSTATE COMMERCE COMMISSION: Texas Electric Railway Company, Applicant herein, having made application to the Interstate Commerce Commission for certificate of public convenience and necessity under section 1, paragraphs (18) to (20), inclusive of the Interstate Commerce Act, permitting the abandonment of its entire line of railroad and the operation thereof, respectfully submits to the Honorable Commission, according to Section 42.9 of regulations promulgated November 27, 1941, the following information: 1. Complete statement of the purpose of the application. Answer: The purpose of this application is to seek certificate of public convenience and necessity permitting Applicant to abandon its entire line of railroad and the operation thereof, the total length in miles of the line sought to be abandoned being 168.08 miles owned, and 5.62 miles of track owned by Dallas Railway & Terminal Company (the local transit company furnishing street car and bus service in Dallas) operated under trackage rights, consisting of two divisions, viz: The Dallas-Denison Division, 73.56 miles owned, and 2.94 miles operated under such trackage rights, extending North from Dallas, Texas to Denison, Texas, and situated in Dallas, Collin and Grayson counties, Texas; The Dallas-Waco Division, 94.52 miles owned, and 2.68 miles operated under such trackage rights, extending South from Dallas, Texas, to Waco, Texas, and situated in Dallas, Ellis, Hill and McLennan counties, Texas. 2. When, by whom, and for what purpose the line was constructed, and its proprietary history. Answer: Applicant's line sought to be abandoned is located wholly within the State of Texas. That part of Applicant's line located between Dallas, Texas, and Sherman, Texas, was constructed by Texas Traction Company during the years 1907 and 1908, and put into operation on July 1, 1908. That part of Applicant's line located between Sherman, Texas, and Denison, Texas, was constructed by Denison & Sherman Railway Company during 1900 and 1901, and put into operation on May 1, 1901. This part of the line was purchased by Texas Traction Company on April 16, 1911, on which date Texas Traction Company began the operation thereof. That part of Applicant's line located between Dallas, Texas, and Waxahachie, Texas, was constructed by Dallas Southern Traction Company during 1911 and 1912. Dallas Southern Traction Company did not operate the line, but on October 3, 1912, sold same to Southern Traction Company, which latter company began the operation thereof on that date. --1-- |
